LAWS OF MARYLAND
(C) THE CHAIRMAN SHALL HAVE POWER OF APPROVAL OF THE
ADMINISTRATION BUDGET TO BE SUBMITTED FOR APPROVAL TO THE
MARYLAND GENERAL ASSEMBLY.
(D) THE CHAIRMAN, AS SECRETARY OF TRANSPORTATION, MAY
PROVIDE THE COMMISSION AND THE ADMINISTRATION WITH THE PERSONNEL
(B) THE CHAIRMAN OF THE COMMISSION SHALL:
(1) SUBJECT TO THE APPROVAL OF THE GOVERNOR APPOINT
THE EXECUTIVE DIRECTOR OF THE ADMINISTRATION IN ACCORDANCE WITH §
3-101 OF ARTICLE 40A; and
(2) APPROVE THE ADMINISTRATION'S BUDGET BEFORE ITS
SUBMISSION TO THE GENERAL ASSEMBLY AS PART OF THE GOVERNOR'S
PROPOSED BUDGET.
(C) THE CHAIRMAN OF THE COMMISSION MAY:
(1) REMOVE THE EXECUTIVE DIRECTOR OF THE
ADMINISTRATION; AND
(2) WHILE ACTING AS SECRETARY OF THE DEPARTMENT,
PROVIDE THE COMMISSION AND THE ADMINISTRATION WITH THE PERSONNEL
OF THE DEPARTMENT THAT THE SECRETARY CONSIDERS NECESSARY FOR THE
PERFORMANCE OF THEIR DUTIES UNDER TO CARRY OUT THE PROVISIONS OF
THIS TITLE.

(A) NOTWITHSTANDING THE PROCUREMENT LAWS OF THIS STATE
EXCEPT FOR STATE FINANCE AND PROCUREMENT ARTICLE, §§ 11-138
(STATE BOARD OF CONTRACT APPEALS), 11-148 (PURCHASES FROM
MINORITY BUSINESS), 11-148.1 (PURCHASES FROM SOUTH AFRICA),
11-149-166 (PROCUREMENT OF ARCHITECTURAL AND ENGINEERING
SERVICES), 11-202-209 (REVIEW OF DESIGNATED CONTRACTS BY BOARD OF
PUBLIC WORKS), 11-213-215 (DISCLOSURE REQUIRED FROM CERTAIN
CONTRACTORS), AND 12-401-405 (STEEL PROCUREMENT FOR PUBLIC
WORKS), PROCUREMENT BY THE COMMISSION AND THE ADMINISTRATION IS
SUBJECT ONLY TO THOSE RULES AND REGULATIONS AS ARE PROMULGATED BY
THE COMMISSION. THE COMMISSION MAY ADOPT RULES AND REGULATIONS
GOVERNING PROCUREMENT BY THE ADMINISTRATION PRIOR TO NOVEMBER
1, 1988 THE COMMISSION SHALL PRESENT THESE RULES AND REGULATIONS
TO THE LEGISLATIVE POLICY COMMITTEE FOR REVIEW. THE PROCUREMENT
RULES AND REGULATIONS SHALL BE CONSISTENT WITH THE FOLLOWING:
(1) IT SHALL BE THE POLICY OF THE COMMISSION TO
INSURE FAIR AND EQUITABLE TREATMENT OF ALL PERSONS THROUGH
EFFECTIVE BROAD-BASED COMPETITION WITHIN THE ADMINISTRATION
PROCUREMENT SYSTEM.
(2) IT IS PREFERRED THAT CONTRACTS FOR THE
CONSTRUCTION, RECONSTRUCTION, IMPROVEMENT, PLANNING, OR
