WILLIAM DONALD SCHAEFER, Governor Ch. 541

ADMINISTRATION IN A COMPETITIVE MANNER WITHIN THE PORT INDUSTRY,
AND TO EXERCISE THOSE POWERS GRANTED TO IT AND TO THE MARYLAND
PORT ADMINISTRATION BY THIS TITLE OR BY ANY OTHER PROVISION OF
LAW.

(B) THE COMMISSION SHALL:

(1) ESTABLISH POLICIES DIRECTED TOWARD IMPROVING THE
COMPETITIVE POSITION OF THE PORTS OF MARYLAND WITHIN THE
INTERNATIONAL PORT INDUSTRY;

(2) ADOPT REGULATIONS FOR THE OPERATION OF THE
ADMINISTRATION IN A COMPETITIVE MANNER WITHIN THE PORT INDUSTRY;

(3) EXERCISE THOSE POWERS GRANTED TO THE COMMISSION
AND TO THE MARYLAND PORT ADMINISTRATION BY THIS TITLE OR BY ANY
OTHER PROVISION OF LAW; AND

(4)  IN CARRYING OUT THE PROVISIONS OF THIS SUBTITLE,
SEEK INFORMATION AND ADVICE FROM PORT LABOR AND MANAGEMENT GROUPS
ON A REGULAR BASIS.

(C)  THE COMMISSION SHALL CONSIST OF 7 MEMBERS, 6 OF WHOM
SHALL BE APPOINTED BY THE GOVERNOR WITH THE ADVICE AND CONSENT OF
THE SENATE AND THE 7TH SHALL BE THE SECRETARY OF TRANSPORTATION
WHO SHALL BE THE CHAIRMAN OF THE COMMISSION.

(D) QUALIFICATIONS AN APPOINTED MEMBER MAY NOT BE AN

OFFICER OR EMPLOYEE OF THE STATE. EACH APPOINTED MEMBER SHALL BE
A RESIDENT OF THIS STATE WHO IS A PERSON OF ABILITY AND

INTEGRITY. MEMBERS SHALL NOT BE APPOINTED AS REPRESENTATIVE OF

ANY SPECIAL INTEREST OR INTERESTS. TWO MEMBERS SHALL BE

RESIDENTS OF THE BALTIMORE AREA (BALTIMORE CITY, BALTIMORE
COUNTY, ANNE ARUNDEL, CARROLL, HOWARD, AND HARFORD COUNTIES), ONE
MEMBER SHALL BE A RESIDENT OF THE EASTERN SHORE (CECIL, KENT,
QUEEN ANNE'S TALBOT, CAROLINE, DORCHESTER, WICOMICO, SOMERSET,
AND WORCESTER COUNTIES), ONE MEMBER SHALL BE A RESIDENT OF
SOUTHERN MARYLAND (ST. MARY'S, CHARLES, AND CALVERT COUNTIES),
ONE MEMBER SHALL BE A RESIDENT OF THE WASHINGTON SUBURBAN AREA
(PRINCE GEORGE'S AND MONTGOMERY COUNTIES) AND ONE MEMBER SHALL BE
A RESIDENT OF WESTERN MARYLAND (FREDERICK, WASHINGTON, ALLEGANY,
AND GARRETT COUNTIES).

(D) (1) THE GOVERNOR MAY NOT APPOINT TO THE COMMISSION:

(I)  AN OFFICER OR EMPLOYEE OF THE STATE;

(II)  A REPRESENTATIVE OF ANY ENTITY WHOSE MAJOR
PRINCIPAL ACTIVITIES ARE PORTS-RELATED;

(III)  A PERSON EMPLOYED BY ANY ENTITY WHOSE
MAJOR PRINCIPAL ACTIVITIES ARE PORTS-RELATED; OR
