WILLIAM DONALD SCHAEFER, Governor Ch. 503

Program under the provisions of the National Historic
Preservation Act of 1966.

[(i)] (K) (L) "STATE UNIT" HAS THE MEANING SET FORTH IN
TITLE 11 OF THE STATE GOVERNMENT ARTICLE.

(L) (M) "SUBMERGED" MEANS BENEATH OR SUBSTANTIALLY BENEATH
THE TERRITORIAL WATERS OF THE STATE.

[(j)] (M) (N) "Trust" means the Maryland Historical Trust.

[(k)] (N) (O) "Undertaking" means a project that involves
or may lead to building construction, building alteration, or
land disturbance.

5-605.

The powers and duties of the Trust shall vest in and be
exercised by a body of fifteen trustees. The Governor of the
State, the President of the Senate of the General Assembly and
the Speaker of the House of Delegates of the General Assembly
shall be by virtue of their offices three of the trustees with
the same powers and duties as the other trustees as hereafter set
forth. The three ex-officio trustees may delegate from time to
time any or all of their powers or duties to an authorized
representative, the Governor's representative to be a member of
the Executive Department of the State of Maryland and the
representatives of the President of the Senate and the Speaker of
the House to be a member of the Senate and the House of
Delegates, respectively. The remaining twelve trustees shall be
appointed by the Governor with the advice and consent of the
Senate. HOWEVER, AT LEAST ONE TRUSTEE SHALL BE QUALIFIED BY

TRAINING AND EXPERIENCE IN THE FIELD OF ARCHAEOLOGY OR

ANTHROPOLOGY SUBMERGED ARCHAEOLOGY. The term of a member is 4
years. The terms of members are staggered as required by the
terms provided for members of the board on July 1, 1985. In the
event that a trustee for any reason fails to serve or to complete
any appointed or elected term, a successor shall be appointed by
the Governor for the remainder of such term. Selection of
trustees whether by delegation or appointment with the advice and
consent of the Senate should be such as to obtain a broad
geographical distribution of trustees throughout the State
insofar as is practicable and consistent with the purpose of the
Trust.

5-611 OF THIS SUBTITLE, ALL SUBMERGED ARCHAEOLOGICAL HISTORIC
PROPERTY LOCATED ON OR RECOVERED FROM LANDS OWNED OR CONTROLLED
BY THE STATE, INCLUDING SUBMERGED LANDS OVER WHICH THE STATE HAS
SOVEREIGN CONTROL , IS THE PROPERTY OF THE STATE.
