Ch. 503                                          LAWS OF MARYLAND

(1)  YIELDS OR IS LIKELY TO YIELD INFORMATION OF
SIGNIFICANCE TO THE SCIENTIFIC STUDY OF HUMAN PREHISTORY,
HISTORY, OR CULTURE; AND

(2)  (I) IS EMBEDDED IN SUBMERGED LANDS AND HAS
REMAINED UNCLAIMED FOR 100 YEARS OR LONGER; OR

(II) IS INCLUDED IN OR HAS BEEN DETERMINED
ELIGIBLE FOR INCLUSION IN THE NATIONAL REGISTER OF HISTORIC
PLACES.

[(b)] (C) "Council" means the Maryland Advisory Council on
Historic Preservation.

[(c)] (D) "Director" means the Director of the Maryland
Historical Trust.

(E) "EMBEDDED" MEANS FIRMLY AFFIXED IN SUBMERGED LANDS SUCH
THAT THE USE OF TOOLS OF EXCAVATION IS REQUIRED IN ORDER TO MOVE
THE BOTTOM SEDIMENTS TO GAIN ACCESS TO THE ARCHAEOLOGICAL
HISTORIC PROPERTY AND ANY PART THEREOF.

[(d)] (E) (F) "Financial assistance" means an action by the
State or a State unit to award grants, loans, loan guarantees, or
insurance to a public or private entity to finance, either in
part or in whole, an undertaking.

[(e)] (F) (G) "Governor's Consulting Committee on the
National Register of Historic Places" means the committee that
reviews nominations to the National Register under the National
Historic Preservation Act of 1966.

[(f)] (G) (H) "Historic property" means a district, site,
building, structure, or object significant in the prehistory,
history, upland and underwater archeology, architecture,
engineering, and culture of the State, including artifacts,
records, and remains related to a district, site, building,
structure, or object.

(H) (I) "PERMITEE PERMITTEE" MEANS ANY PERSON OR ENTITY
AUTHORIZED AND GIVEN THE EXCLUSIVE RIGHT BY THE MARYLAND
HISTORICAL TRUST TO EXCAVATE OR DISTURB AN A SUBMERGED
ARCHAEOLOGICAL HISTORIC PROPERTY UNDER THE PROVISIONS OF § 5-620
OF THIS SUBTITLE.

[(g)](I) (J) "Preservation" means the identification,
evaluation, recordation, documentation, curation, acquisition,
protection, management, rehabilitation, restoration,
stabilization, maintenance, and reconstruction of a historic
property.

[(h)] (J) (K) "State Historic Preservation Officer" means
the individual who administers the State Historic Preservation
