CHAPTER 503

(House Bill 1304)

AN ACT concerning

Maryland Historical Trust - Submerged
Archaeological Historic Property

FOR the purpose of authorizing the Maryland Historical Trust to
establish a program for the issuance and administration of
permits for certain activities relating to submerged
archaeological historic property on land owned or controlled
by the State, on submerged lands over which the State has
sovereign control, and on land in any cave; creating certain
definitions; defining certain terms; requiring that at least
one trustee of the Maryland Historical Trust shall be
qualified in the field of submerged archaeology or
anthropology; providing that certain submerged
archaeological historic property is the property of the
State, title to which may be conveyed by the Trust Board of
Public Works
; requiring certain approval from the Board of
Public Works;
directing all State units to assist the
Maryland Historical Trust in carrying out its statutory
functions and all State and local law enforcement agencies
to enforce certain provisions of this Act and the terms of
permits issued under the Act; requiring that certain
permittees receive certain compensations;
granting the
Director of Maryland Historical Trust and his designees
certain enforcement powers; requiring that the Maryland
Historical Trust establish a certain educational program and
adopt certain regulations; providing for certain penalties
for violation of this Act; transferring certain personnel
from the Department of Natural Resources to the Maryland
Historical Trust of the Department of Housing and Community
Development subject to certain conditions; and generally
relating to the establishment of a program within the
Maryland Historical Trust for the issuance and
administration of permits relating to submerged
archaeological historic property and to the transfer of
archaelogical related functions to the Maryland Historical
Trust.
