(a)  Except as otherwise provided in this section, a family
day care home may not operate unless it is registered.

(b)  A family day care home is not required to be registered
if the day care provider:

(1)  is related to each child by blood or marriage;

(2)  is a friend of each child's parents or legal
guardian and the care is provided on an occasional basis; or

(3)  has received the care of the child from a child
placement agency licensed by the Administration or by a local
department.

(C) A PERSON MAY NOT ADVERTISE A FAMILY DAY CARE HOME OR
FAMILY DAY CARE SERVICE UNLESS THE FAMILY DAY CARE HOME IS
REGISTERED UNDER THE PROVISIONS OF THIS PART V OF THIS SUBTITLE.

A person who violates any provision of this Part V of this
subtitle or any rule or regulation adopted under this Part V of
this subtitle is guilty of a misdemeanor and on conviction is
subject to a fine not exceeding $500.

Article - Commercial Law

11-701.

(a)  In this subtitle the following words have the meanings
indicated.

(b)  "Advertise falsely" means to use any advertisement,
including a label, which is misleading in a material respect.

(c)  "Person" includes an individual, corporation, business
trust, estate, trust, partnership, association, two or more
persons having a joint or common interest, or any other legal or
commercial entity.

11-702.

[This] EXCEPT AS OTHERWISE PROVIDED IN § 11-703.1, THIS
subtitle does not apply to any:

(1)  Television or radio broadcasting station which
broadcasts an advertisement; or                                                         

(2)  Publisher or printer of a newspaper, magazine, or
other form of printed advertisement who publishes or prints an
advertisement.
