Ch. 412                                          LAWS OF MARYLAND

(1)  Shall carry out any construction in accordance
with the approved plans; and

(2)  May not change the methods of disposing of waste
at an industrial establishment except in accordance with a permit
issued by the Secretary under this section.]

9-252.

(a)  (2) The Secretary may:

(i) Require any public water supply system,,
public sewerage system, or [public] refuse disposal system to be
operated in a manner that will protect public health and comfort;
and

(ii) Order the alteration,, extension, or
replacement of any public water supply system,, public sewerage
system, or [public] refuse disposal system.

(b)  The Secretary:

(3)  Shall examine all [public] water supply
systems[,] AND PUBLIC sewerage systems FOR PUBLIC USE, and
refuse disposal systems; and

(4)  Shall approve or disapprove the design and
construction of any [public] water supply system [,] OR
PUBLIC sewerage system FOR PUBLIC USE, or refuse disposal system
that is to be built in this State.

9-268.

(a) In this section, "person" includes a water, sewerage,
or sanitary district.

[(b) A person is liable to the State for civil penalties if
the person:

(1)  Fails to comply with a final order of the
Secretary within the time set for compliance with the order; or

(2)  After an appeal has been filed, fails to obey or
in good faith begin to obey a final order of the Secretary within
10 days after the court enters a final judgment affirming the
order.]

[(c) These civil penalties are:

(1) A basic penalty not less than $500 nor more than
$10,000; and
