Ch. 376 LAWS OF MARYLAND
THE TENANT REMAIN ON OR NEAR A PUBLIC HIGHWAY FOR MORE THAN 72
HOURS AFTER REMOVAL FROM THE LANDLORD'S PROPERTY, THEY SHALL BE
DEEMED ABANDONED. THE COUNTY COMMISSIONERS MAY MOVE THE ITEMS TO
A LANDFILL OR OTHERWISE DISPOSE OF THE PROPERTY.
FOR the purpose of authorizing the County Commissioners in
Carroll County to move certain personal property found on a
tenant's premises to a landfill or, after a certain time
period of making the personal property available to the
tenant to repossess, otherwise dispose of the property if
the personal property remains on or near a public highway
for more than a certain period of time after an eviction;
defining a term; and generally relating to the disposition
of personal property removed from a premises after an
eviction in Carroll County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 7 - Carroll County
3-78.
(A) IN THIS SECTION, "HIGHWAY" HAS THE MEANING STATED IN §
8-101 OF THE TRANSPORTATION ARTICLE OF THE ANNOTATED CODE OF
MARYLAND.
(B) (1) IF PERSONAL PROPERTY, INCLUDING FURNITURE,
IMPLEMENTS, TOOLS, GOODS, EFFECTS, OR OTHER CHATTEL REMOVED FROM
A LANDLORD'S PROPERTY UNDER AN EVICTION OF A TENANT REMAIN ON OR
NEAR A PUBLIC HIGHWAY FOR MORE THAN 7 2 HOURS, THE PERSONAL
PROPERTY SHALL BE DEEMED ABANDONED.
(2) THE COUNTY COMMISSIONERS MAY MOVE THE PERSONAL
PROPERTY TO A LANDFILL OR, AFTER MAKING THE PERSONAL PROPERTY
AVAILABLE FOR AT LEAST 7 DAYS TO THE TENANT TO REPOSSESS,
OTHERWISE DISPOSE OF THE PERSONAL PROPERTY.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
