AN ACT concerning
CHAPTER 374
(House Bill 117)
Smoke Detectors
FOR the purpose of requiring certain additional smoke detectors
in certain new residential dwelling units; defining certain
terms; requiring the owner of a residential dwelling to
install smoke detectors and to perform certain other duties
under certain conditions; clarifying certain individuals'
responsibilities for the maintenance of smoke detectors; and
generally relating to the installation and maintenance of
smoke detectors after a certain date; providing a certain
exemption; permitting each county to enact certain more
stringent provisions; authorizing any county fire chief,
fire administrator, or municipal fire chief to enforce the
provisions of this Act; and generally relating to smoke
detectors in new residential dwelling units.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 38A - Fires and Investigations
12A.
(A)(1) IN THIS SECTION, THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(2) "DWELLING UNIT" MEANS A SINGLE UNIT PROVIDING
COMPLETE, INDEPENDENT LIVING FACILITIES FOR 1 OR MORE PERSONS
INCLUDING PERMANENT PROVISIONS FOR LIVING, SLEEPING, EATING,
COOKING, AND SANITATION.
