Ch. 288                                            LAWS OF MARYLAND

(2)  30 days care [in a Type C or D facility for the
treatment of alcoholism] FOR THE TREATMENT OF DRUG ABUSE, ALCOHOL
ABUSE, OR ALCOHOLISM, IN AN ALCOHOL OR DRUG ABUSE FACILITY
licensed by the Department of Health and Mental Hygiene Division
of Licensing and Enforcement and certified by that Department's
Alcoholism Control Administration; and

(3)   30 outpatient visits at a certified alcoholism OR
DRUG ABUSE treatment facility. The benefit for outpatient visits
may be limited to not less than [$1,000] $3,000 during any
calendar year or benefit period UNLESS GREATER BENEFITS ARE
PROVIDED BY THE CONTRACT, THE BENEFITS FOR OUTPATIENT VISITS
DURING ANY CALENDAR YEAR OR BENEFIT PERIOD SHALL BE EQUAL TO 100
PERCENT OF THE COST OF CARE OR $3,000, WHICHEVER IS LESS.

(b) Any group major medical contract, policy or
certificate, including one issued by a nonprofit health service
plan, that provides benefits
for both hospitalization and medical
care shall provide benefits equal to at least half those required
by subsection (a) of this section.

(c) Under subsection (a) of this section, the total number
of days and visits combined may be limited to 120 during the
covered person's lifetime. [The maximum benefit under subsection
(b) of this section in the aggregate during any calendar year or
benefit period may be limited to not less than $1,000] UNLESS

GREATER BENEFITS ARE PROVIDED BY THE CONTRACT, THE BENEFITS UNDER
SUBSECTION (B) OF THIS SECTION DURING ANY CALENDAR YEAR OR
BENEFIT PERIOD SHALL BE EQUAL TO 100 PERCENT OF THE COST REQUIRED
TO BE PAID UNDER SUBSECTION (B) OR $3,000 WHICHEVER IS LESS.----

(D) FOR THE PURPOSES OF THIS SECTION, "DRUG ABUSE" HAS THE
MEANING STATED IN §
9-101 OF THE HEALTH - GENERAL ARTICLE.

Article - Health - General

9-101.

(e) (1) "Drug abuse" means:

(i) Misuse or unlawful use of a drug;

(ii) Drug dependence; or

(iii) Drug addiction.

(2) "Drug abuse" does not include taking a drug
according to a lawful prescription that is issued, in the course
of professional treatment, for a legitimate medical purpose.
