BY repealing and reenacting, with amendments,

Article - State Finance and Procurement

Section 13-219(c)

(1985 Volume and 1987 Supplement)

(As enacted by Chapter (H.B. 1) of the Acts

of the General Assembly of 1988)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Finance and Procurement

11-209.

(a) Every State procurement contract shall contain
provisions obligating the contractor not to discriminate in any
manner against any employee or applicant for employment because
of sex, race, AGE, creed, color, or national origin and
obligating the contractor to include a similar clause in all
subcontracts, except subcontracts for standard commercial
supplies or raw materials. In addition, the contractor and
subcontractor shall agree to post in conspicuous places,
available to employees and applicants for employment, notices
setting forth the provisions of the nondiscrimination clause.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

13-219.

(c) The nondiscrimination clause shall:

(1)  Prohibit discrimination in any manner by the
contractor against an employee or applicant for employment
because of sex, race, AGE, color, creed, or national origin;

(2)  Require the contractor to include a similar
clause in every subcontract except a subcontract for standard
commercial supplies or raw materials; and

(3)  Require each contractor and subcontractor subject
to this clause to post conspicuously a notice that sets forth the
provisions of the clause in a place that is available to
employees and applicants for employment.

SECTION 3. AND BE IT FURTHER ENACTED, That Section 1 of
this Act shall take effect July 1, 1988 and shall remain in
