11.

(a) The provisions of this Act, being necessary for the
welfare of the State and its inhabitants, shall be liberally
construed to effect the purposes thereof.

(b) The provisions of this Act are severable, and if any of
such provisions shall be held unconstitutional by any court of
competent jurisdiction, the decision of such court shall not
affect or impair any of the remaining provisions.

SECTION 25. AND BE IT FURTHER ENACTED, That the initial
overall plan required to be developed adopted by the Board of
Regents of the University of Maryland system under § 12-1069(a)
of the Education Article, as enacted by this Act, shall be
prepared by the Board by July 1, 1989.

SECTION 26. AND BE IT FURTHER ENACTED, That except as to
the Maryland Higher Education Commission, Morgan State University
and St. Mary's College of Maryland has have all of the authority
and all of the powers, rights, and privileges to manage and
conduct its their affairs as it they held on June 30, 1988.

SECTION 27. AND BE IT FURTHER ENACTED, That the provisions
of this Act
exempting from the examination applicants who are
planning to attend, or are attending, a Maryland community
college shall be construed prospectively and shall be applicable
to those applying for a scholarship award during fiscal year 1989
for the 1989-1990 academic year.

SECTION 18. AND BE IT FURTHER ENACTED, That during fiscal
year 1989, "low and moderate family income" shall mean an annual
family income of $25,000 or less, and in subsequent years the
State Scholarship Administration shall develop regulations
defining "low and moderate family income".

SECTION 29. AND BE IT FURTHER ENACTED, That it is the
intent of the General Assembly that during fiscal year 1989, the
Board of Public Works make available to the Maryland Higher
Education Commission from the General Emergency fund through the
budget amendment process an amount not exceeding $50,000 as
needed for the development of computer software to assist the
State Scholarship Administration to implement the distribution of
General State Scholarship Funds to students of families with low
and moderate incomes during the 1988-1989 academic year.
