WILLIAM DONALD SCHAEFER, Governor                   Ch. 190

requirements relating to the denial of, or receipt of
commitments for insufficient amounts of, private financing;
permitting rehabilitation projects under the Nonprofit
Rehabilitation Program to provide space for certain
nonresidential uses; authorizing the Department of Housing
and Community Development to limit the return on equity
allowed to sponsors and nonprofit sponsors or enter into
equity participation agreements with sponsors and nonprofit
sponsors under the Maryland Housing Rehabilitation Program;
making certain technical corrections; and generally relating
to the Maryland Housing Rehabilitation Program and certain
of its programs.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 41B - Department of Housing and Community Development

2-301.

The General Assembly finds and declares:

(7) That [lead paint in older housing] THE PRESENCE
OF RADON GAS, ASBESTOS, OR LEAD PAINT IN BUILDINGS is a major
[source of lead poisoning in children] DETRIMENT TO HEALTH AND
SAFETY OF PERSONS in the State and the [prevention of lead
poisoning] REDUCTION AND ELIMINATION OF RADON GAS, ASBESTOS, AND
LEAD PAINT by modifying such [housing] BUILDINGS to provide a
[lead-safe]-HEALTHIER AND SAFER environment is desirable and a
proper public purpose for which public money may be expended; and

(7) (I) That lead paint in older housing is a major

source of lead poisoning in children in the State and the

prevention of lead poisoning by modifying such housing to provide
