CHAPTER 148

(Senate Bill 524)

AN ACT concerning

Jurisdiction - District Court and Circuit Court

FOR the purpose of clarifying specifying that a circuit court,
and not the District Court, has jurisdiction of certain
offenses if the circuit court has jurisdiction of another
offense arising from the same circumstances; and generally
relating to the jurisdictions of the District Court and the
circuit courts over certain offenses.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

4-302.

(f) Except as provided in Title 4, Subtitle 5 of the Family
Law Article, the District Court does not have jurisdiction of an

offense otherwise within the District Court's exclusive

jurisdiction if [a person is charged with another offense in] the
circuit court HAS JURISDICTION OF ANOTHER OFFENSE arising from
the same circumstances. In this case, the circuit court for the
county has exclusive original jurisdiction over all the offensss.

(F) (1) EXCEPT AS PROVIDED IN TITLE 4, SUBTITLE 5 OF THE
FAMILY LAW ARTICLE, THE DISTRICT COURT DOES NOT HAVE JURISDICTION
OF AN OFFENSE OTHERWISE WITHIN THE DISTRICT COURT'S JURISDICTION
