for the services of an architectural, engineering, or consultant
firm for design or consultation purposes. In Frederick County,
contracts for architectural and engineering services costing more
than $5,000, shall be awarded on a competitive basis which shall
consist of either sealed competitive bids or competitive
[negotiation as defined in § 13-101(b) of the State Finance and
Procurement Article] NEGOTIATION. "COMPETITIVE NEGOTIATION" MEANS
A PROCESS THAT INCLUDES THE SUBMISSION OF WRITTEN TECHNICAL AND
PRICE PROPOSALS FROM TWO OR MORE SOURCES AND A WRITTEN EVALUATION
OF THOSE PROPOSALS IN ACCORDANCE WITH EVALUATION CRITERIA.
REVISOR'S NOTE: Chapter ___, Acts of 1988, which enacted
Division II of the State Finance and Procurement
Article, also amended subsection (1)(4) of this
section to delete the obsolete cross-reference to SF,
§ 13-101(b) and to add the definition of "competitive
negotiation".
Chapter 840, Acts of 1986, which substantively revised
the procurement laws, repealed the definition of
"competitive negotiation" in former SF, § 13-101(b).
Chapter ____, Acts of 1988, restored that former
definition to subsection (1) of this section.

(a) (3) (i) The provisions of this subsection shall be
suspended by the Board of Public Works if the Board of Public
Works determines that, as a result of the volume and scope of
activities and sales by State Use Industries, the purposes of
[Divisions II and III] DIVISION II of the State Finance and
Procurement Article are being unduly eroded.
