Ch. 48                                          LAWS OF MARYLAND

REVISOR'S NOTE: This section is new language derived
without substantive change from the first three
sentences of former SF § 12-302(a) and the reference
in the first sentence of § 12-304(b) to the payment of
prevailing wage rates as being "mandatory upon the
contractor".

Defined terms: "Employee" § 17-201
"Prevailing wage rate" § 17-201
"Public work contract" § 17-201

17-215. FULL PAYMENT REQUIRED.

(A)  IN GENERAL.

EACH CONTRACTOR AND SUBCONTRACTOR SUBJECT TO THIS SUBTITLE
SHALL PAY EACH EMPLOYEE NOT LESS THAN THE PREVAILING WAGE RATE
REQUIRED UNDER THIS SUBTITLE:

(1)  UNCONDITIONALLY;

(2)  WITHOUT SUBSEQUENT REBATE; AND

(3)  EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS
SECTION, WITHOUT DEDUCTIONS FOR:

(I)  FOOD;

(II)  SLEEPING ACCOMMODATIONS;

(III)  TRANSPORTATION;

(IV)  USE OF SMALL TOOLS; OR

(V)  ANY OTHER THING OF ANY KIND.

(B)  DEDUCTIONS.

A CONTRACTOR OR SUBCONTRACTOR MAY MAKE DEDUCTIONS THAT ARE:

(1)  REQUIRED BY LAW;

(2)  REQUIRED OR ALLOWED BY A COLLECTIVE BARGAINING
AGREEMENT BETWEEN A BONA FIDE LABOR ORGANIZATION AND THE
CONTRACTOR OR SUBCONTRACTOR; OR

(3)  CONTAINED IN A WRITTEN AGREEMENT BETWEEN AN
EMPLOYEE AND AN EMPLOYER UNDERTAKEN AT THE BEGINNING OF
EMPLOYMENT, IF THE AGREEMENT:

(I) CONCERNS FOOD, SLEEPING ACCOMMODATIONS, OR
OTHER SIMILAR ITEMS;
