2. WITH RESPECT TO THE CONSTRUCTION OF
ANY OTHER PUBLIC WORK FOR WHICH 50% OR MORE OF THE MONEY USED FOR
CONSTRUCTION IS STATE MONEY; AND

(IV) NOTWITHSTANDING PARAGRAPH (2)(II) OF THIS
SUBSECTION, A POLITICAL SUBDIVISION IF ITS GOVERNING BODY:

1.  PROVIDES BY ORDINANCE OR RESOLUTION
THAT THE POLITICAL SUBDIVISION IS COVERED BY THIS SUBTITLE; AND

2.  GIVES WRITTEN NOTICE OF THAT ORDINANCE
OR RESOLUTION TO THE COMMISSIONER.

(2) "PUBLIC BODY" DOES NOT INCLUDE:

(I)  A UNIT OF THE STATE GOVERNMENT OR
INSTRUMENTALITY OF THE STATE FUNDED WHOLLY FROM A SOURCE OTHER
THAN THE STATE; OR

(II) A POLITICAL SUBDIVISION, AGENCY, PERSON,
OR ENTITY IF LESS THAN 50% OF THE MONEY FOR CONSTRUCTION OF A
PARTICULAR PUBLIC WORK IS STATE MONEY.

(II)  ANY POLITICAL SUBDIVISION, AGENCY, PERSON,
OR ENTITY:

1. WITH RESPECT TO THE CONSTRUCTION OF AN
ELEMENTARY OR SECONDARY SCHOOL FOR WHICH LESS THAN 7 5% OF THE
MONEY USED FOR CONSTRUCTION IS STATE MONEY; OR

2. WITH RESPECT TO THE CONSTRUCTION OF
ANY OTHER PUBLIC WORK FOR WHICH LESS THAN 50% OF THE MONEY USED
FOR CONSTRUCTION IS STATE MONEY.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former SF § 12-301(d).

In paragraphs (l)(ii) and (2)(i) of this subsection,
the reference to a "unit of the State government" is
substituted for the former references to a
"department, officer, board, commission, [and] agency
... of the State" and "State agency" to conform to the
language used throughout this article. See the
General Revisor's Note to this Division II.

In the introductory language of paragraph (l)(iii) of
this subsection, the former reference to a
"corporation" is deleted as included in the defined
term "person".

In paragraph (2)(ii) of this subsection, the reference
to "a political subdivision, agency, person, or
entity" is substituted for the former reference to
