Baltimore City, and § ll-101(g) of this article, which
provides that "county" means "unless expressly
provided otherwise, Baltimore City".

In paragraph (2) of this subsection, the specific
reference to "counties" is substituted for the former
general reference to "subdivisions", for clarity.

§ 11-101

(H) PREVAILING WAGE RATE.

"PREVAILING WAGE RATE" MEANS THE HOURLY RATE OF WAGES PAID
IN THE LOCALITY AS DETERMINED BY THE COMMISSIONER UNDER § 17-208
OF THIS SUBTITLE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first sentence of
former SF § 12-301(e)(1), as that sentence referred to
the definition for the term "prevailing wage rate".

The former variations of the defined term are deleted
since "prevailing wage rate" is used consistently
throughout this subtitle. Those former references
were: "[p]revailing hourly rate of wages", "prevailing
hourly wage rate", "prevailing rate of wages",
"prevailing hourly wage", "prevailing wage", "rate of
wages", and "wage rates".

"Locality" § 17-201

§ 17-201

(I) PUBLIC BODY.

(1)' "PUBLIC BODY" MEANS:

(I)  THE STATE;

(II)  EXCEPT AS PROVIDED IN PARAGRAPH (2)(I) OF
THIS SUBSECTION, A UNIT OF THE STATE GOVERNMENT OR
INSTRUMENTALITY OF THE STATE;

PERSON, OR ENTITY:

(III) ANY POLITICAL SUBDIVISION,

AGENCY,

1. WITH RESPECT TO THE CONSTRUCTION OF AN
ELEMENTARY OR SECONDARY SCHOOL FOR WHICH 7 5% OR MORE OF THE MONEY
USED FOR CONSTRUCTION IS STATE MONEY; OR
