LAWS OF MARYLAND

(2) THE REQUIREMENTS OF THIS SUBSECTION SHALL BE
SATISFIED BY AN AFFIDAVIT THAT:

(I)  INCORPORATES BY REFERENCE THE STATEMENTS
CONTAINED IN AN AFFIDAVIT SUBMITTED UNDER THIS SECTION TO THE
SAME PUBLIC BODY WITHIN THE PREVIOUS YEAR; AND

(II)  STATES THAT THE STATEMENTS CONTAINED IN
THE EARLIER AFFIDAVIT REMAIN ACCURATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § 12-107.

In subsection (b)(2)(i) of this section, the reference
to a "public body" is substituted for the former
reference to a "procurement agency", to conform to the
other references throughout this section.

16-203. DEBARMENT FOR BRIBERY.

(A)  SCOPE OF SECTION.

THIS SECTION DOES NOT APPLY TO AN ACT OR OMISSION THAT
OCCURRED ON OR BEFORE JUNE 30, 1977.

(B)  DEBARMENT REQUIRED.

A PERSON SHALL BE DEBARRED FROM ENTERING INTO A CONTRACT
WITH A PUBLIC BODY IF THE PERSON HAS BEEN CONVICTED UNDER ARTICLE
27 OF THE CODE FOR BRIBERY, ATTEMPTED BRIBERY, OR CONSPIRACY TO
BRIBE IN CONNECTION WITH THE "AWARD OF A CONTRACT BY A PUBLIC
BODY.

(C)  DEBARMENT ALLOWED.

A PERSON MAY BE DEBARRED FROM ENTERING INTO A CONTRACT WITH
A PUBLIC BODY IF:

(1) THE PERSON HAS BEEN CONVICTED OF BRIBERY,
ATTEMPTED BRIBERY, OR CONSPIRACY TO BRIBE:

(I)  UNDER THE LAWS OF THE FEDERAL GOVERNMENT OR
ANY OTHER STATE; OR

(II)  UNDER THE LAWS OF THIS STATE ARTICLE 27 OF
THE CODE FOR AN ACT THAT DOES NOT RESULT IN DEBARMENT UNDER
SUBSECTION (B) OF THIS SECTION; OR
