(C) PUBLIC BODY.
"PUBLIC BODY" MEANS:

(1)  THE STATE;

(2)  A UNIT; OR

(3)  A LOCAL GOVERNMENTAL ENTITY IN THE STATE,
INCLUDING A BICOUNTY OR MULTICOUNTY GOVERNMENTAL ENTITY.

REVISOR'S NOTE: This subsection is new language added to
avoid repetition of phrases such as "the State or any
of its subdivisions" and "State or other subdivision
contracting agency".

In light of this addition, the word "subdivision" no
longer appears in this revised subtitle. Therefore,
the substance of former SF § 12-101(e), which defined
"[subdivision", is incorporated in item (3) of this
subsection, and former § 12-101(e) is deleted.

Defined term: "Unit" § 11-101

REVISOR'S NOTE TO SECTION: Former SF § 12-101(d), which
defined "person" as having "the same meaning provided
in § 11-101 of this article", is deleted as
surplusage.

16-202. "NO CONVICTION" AFFIDAVIT.

(A)  REQUIRED.

WHEN A PERSON SUBMITS A BID OR OTHERWISE APPLIES FOR A
CONTRACT WITH A PUBLIC BODY, THE PERSON SHALL SUBMIT AN AFFIDAVIT
THAT MEETS THE REQUIREMENTS OF SUBSECTION (B) OF THIS SECTION.

(B)  CONTENTS.

(1) AN AFFIDAVIT UNDER THIS SECTION SHALL STATE, TO
THE BEST KNOWLEDGE OF THE PERSON SUBMITTING THE AFFIDAVIT,
WHETHER ANY OF THE FOLLOWING PERSONS HAS BEEN CONVICTED OF
BRIBERY, ATTEMPTED BRIBERY, OR CONSPIRACY TO BRIBE UNDER THE LAW
OF ANY STATE OR THE FEDERAL GOVERNMENT:

(I)  THE PERSON SUBMITTING THE AFFIDAVIT;

(II)  AN. OFFICER, DIRECTOR, OR PARTNER OF THAT
PERSON; OR

(III)  AN EMPLOYEE OF THAT PERSON WHO IS
DIRECTLY INVOLVED IN OBTAINING CONTRACTS WITH A PUBLIC BODY.
