The former enumeration "agency, association, board,
bureau, college, commission, committee, council,
foundation, fund, department, institute, institution,
public corporation, service, trust, [and] university"
and the former reference to a "subunit" are deleted as
included in the word "unit". See the General
Revisor's Note to this Division II.

16-102. SCOPE OF SUBTITLE.

THIS SUBTITLE IS BROADLY APPLICABLE TO ALL PROCUREMENTS BY
THE STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § ll-201(a).

Defined term: "Procurement" § 11-101

16-103. DEBARMENT BY BOARD.

(A)  ALLOWED.

AFTER REASONABLE NOTICE AND A REASONABLE OPPORTUNITY FOR A
HEARING, THE BOARD MAY DEBAR A PERSON, FOR ANY REASON CAUSE
SPECIFIED IN § 16-104 OF THIS SUBTITLE, FROM:

(1)  BEING CONSIDERED FOR A STATE CONTRACT; OR

(2)  BEING AWARDED A STATE CONTRACT.

(B)  SUSPENSION PENDING FINAL DECISION.

WHILE A FINAL DECISION ON DEBARMENT IS PENDING, THE BOARD
MAY SUSPEND A PERSON FROM PARTICIPATING IN ACTIVITIES RELATED TO
OBTAINING STATE CONTRACTS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § ll-211(c).

In subsection (a) of this section, "the words
specified in § 16-104 of this subtitle" are added to
clarify the former vague reference to "cause".

In subsection (b) of this section, the reference to
suspending a person "from participating in activities
related to obtaining State contracts" is added for
clarity.
