In item (1) and the introductory language of item (2)
of this section, references to "the Republic of South
Africa" are substituted for the former references to
"South Africa", for accuracy and consistency. The
former law used both the words "South Africa" and the
words "the Republic of South Africa" interchangeably.

14-504. NOTICE IN SOLICITATION.

IN ANY SOLICITATION, A UNIT SHALL PROVIDE NOTICE OF THE
REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This section formerly appeared as SF §
11-148.5.

The defined term "unit" is substituted for the former
word "State", since units issue invitations for bids
and other solicitations. The substituted language
also conforms to § 14-502 of this subtitle.

The word "ample", which formerly modified the word
"notice", is deleted as meaningless and without legal
effect. The Procurement Revision Review Committee
invites the attention of the General Assembly to this
deletion.

There are no other changes.

14-505. WAIVER OF REQUIREMENTS.

THE BOARD MAY WAIVE THE REQUIREMENTS OF § 14-502, § 14-503,
OR § 14-504 OF THIS SUBTITLE IF THE BOARD FINDS THAT:

(1)  THE PROCUREMENT IS ESSENTIAL OR IN THE BEST
INTERESTS OF THE STATE; AND

(2)  THERE IS NO OTHER KNOWN SOURCE FOR THE
PROCUREMENT AT A REASONABLE COST.
