12-104. REGULATIONS.
(A) IN GENERAL.
TO CARRY OUT THIS DIVISION II, THE BOARD MAY:
(1) SET POLICY;
(2) ADOPT REGULATIONS IN ACCORDANCE WITH TITLE 10,
SUBTITLE 1 OF THE STATE GOVERNMENT ARTICLE; AND
(3) ESTABLISH INTERNAL OPERATING PROCEDURES FOR
ITSELF.
(B) OVERSIGHT OF PRIMARY PROCUREMENT UNITS.
(1) THE BOARD SHALL ENSURE THAT THE PROPOSED AND
FINAL REGULATIONS OF EACH OF THE PRIMARY PROCUREMENT UNITS:
(I) PROVIDE PROCEDURES THAT ARE CONSISTENT WITH
THIS DIVISION II AND WITH § 12-108 OF THIS SUBTITLE; AND
(II) UNLESS THE CIRCUMSTANCES OF A PARTICULAR
TYPE OF PROCUREMENT OR A PARTICULAR UNIT REQUIRE OTHERWISE, ARE
SUBSTANTIALLY THE SAME.
(II) SUBJECT TO THE APPROVAL THE BOARD, THE PRIMARY
PROCUREMENT UNITS SHALL ADOPT REGULATIONS UNDER § 12-108 OF THIS
SUBTITLE.
12-105 12-104. PROCUREMENT CONTRACTS OUTSIDE UNITED STATES.
(A) MODIFICATION OF REQUIREMENTS.
EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS SECTION, THE
BOARD MAY MODIFY OR WAIVE ANY REQUIREMENT UNDER THIS DIVISION II
