(B) ESTABLISHMENT OF ADVISORY BODIES.
THE BOARD MAY ESTABLISH THE ADVISORY BODIES THAT IT
CONSIDERS APPROPRIATE.
IN ACCORDANCE WITH THE STATE BUDGET, THE BOARD MAY APPOINT
THE STAFF NECESSARY TO CARRY OUT ITS RESPONSIBILITIES UNDER THIS
DIVISION II.
REVISOR'S NOTE: This section is new language derived
without substantive change from former SF § ll-106(b).
The former clause "it deems appropriate" is deleted as
unnecessary in light of the word "may" and as possibly
inconsistent with the limitation "in accordance with
the State budget".

12-103. BOARD PROCUREMENTS.
(A) SCOPE OF SECTION.
(1) THE BOARD MAY DELEGATE ANY OF ITS AUTHORITY OVER
PROCUREMENT IN ACCORDANCE WITH THIS SECTION.
(2) THE BOARD MAY REQUIRE PRIOR BOARD APPROVAL FOR
PROCUREMENT ACTIONS THAT ARE BASED ON SPECIFIC DELEGATION OF
AUTHORITY BY THE BOARD.
THIS SECTION DOES NOT APPLY TO CAPITAL EXPENDITURES BY THE
DEPARTMENT OF TRANSPORTATION OR THE MARYLAND TRANSPORTATION
AUTHORITY, IN CONNECTION WITH STATE ROADS, BRIDGES, OR HIGHWAYS,
AS PROVIDED IN § 12-202 OF THIS TITLE.
(B) AUTHORITY OF BOARD.
(1) NOTWITHSTANDING ANY DELEGATION OF AUTHORITY UNDER
SUBSECTION (A) OF THIS SECTION § 12-101 OF THIS SUBTITLE, THE
BOARD RETAINS FULL AUTHORITY TO ENGAGE IN PROCUREMENT OF SERVICES
AND SUPPLIES FOR ITSELF.
(2)
(C) DELEGATION.
BY RESOLUTION, THE BOARD MAY AUTHORIZE A BOARD MEMBER OR A
UNIT TO EXERCISE ALL OR ANY PART OF THE AUTHORITY OF THE BOARD
FOR A SPECIFIC BOARD PROCUREMENT OR FOR A PARTICULAR CLASS OF
BOARD PROCUREMENTS.
