Ch. 30

LAWS OF MARYLAND

WHEREAS, The prohibitions of Chapters 90 and 96 of 1982 were
phased into place for consumers within the affected age group, so
that the application of Chapters 90 and 96 became completely
effective only after all consumers born before July 1, 1964
reached their twenty-first birthdays, on or before June 30, 1985;
and

WHEREAS, There remain in the law obsolete provisions and
cross-references relating to the consumption of alcohol by
certain minors; and

WHEREAS, There remain however also remain in the law certain
related statutory provisions permitting loitering outside the
establishments of alcoholic beverages licensees by consumers
under 21 years of age; and

WHEREAS, There also remain provisions permitting persons
under 21 years of age to sell alcoholic beverages; and

WHEREAS, Those remaining provisions should be repealed; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

2.

(t) [(1)] "Consumer" means any natural person 21 years old
or older or any corporation not otherwise interdicted by this
article or any other law of this State, who buys, possesses,
keeps or transports alcoholic beverages upon which the taxes
provided by the tax provisions of this article have been paid,
for his own use and not for sale.

[(2) In the case of beer and light wine, "consumer"
includes any natural person over the age of 21 years, and any
natural person under 21 years of age who was born before July 1,
1964, and any corporation not otherwise interdicted by this
article or any other law of this State, who buys, possesses,
keeps or transports beer or light wine upon which the taxes
provided by the tax provisions of this article have been paid,
for his own use and not for sale.]

120.

(a) In Allegany County it is lawful for any licensee under
this article to employ any person [between the ages of 18 and] 21
years OF AGE OR OLDER for the general purposes of employment[,
but this person may not sell or serve alcoholic beverages except
beer and light wine]. In order to be permitted to sell or serve
