SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 27 - Crimes and Punishments
255.
(G) (1) THIS SUBSECTION APPLIES TO HOWARD COUNTY.
(2) THE PROVISIONS OF SUBSECTION (B) OF THIS SECTION
DO NOT APPLY TO BINGO WHICH IS CONTROLLED BY § 250 OF THIS
SUBTITLE.
(3) IN THIS SUBSECTION "BONA FIDE ORGANIZATION" DOES
NOT INCLUDE AN ORGANIZATION THAT HAS BEEN OPERATING IN HOWARD
COUNTY FOR LESS THAN 5 YEARS IMMEDIATELY PRECEDING THE DATE OF
THE ORGANIZATION'S APPLICATION FOR A PERMIT TO HOLD AN EVENT
UNDER THIS SECTION.
(4) A BONA FIDE ORGANIZATION MAY CONTRACT FOR
PROFESSIONAL SERVICES TO ASSIST IN THE OPERATION OF AN EVENT
UNDER THIS SECTION FOR A FEE OR PERCENTAGE, IF:
(I) THE FEE CHARGED FOR THE PROFESSIONAL
SERVICES DOES NOT EXCEED 25 PERCENT OF THE GROSS RECEIPTS OF THE
EVENT; AND
(II) THE MEMBERS OF THE BONA FIDE ORGANIZATION
SUPERVISE THE SERVICES PROVIDED BY THE CONTRACTOR.
(5)(I) A BONAFIDE ORGANIZATION SHALL CERTIFY, UNDER
OATH AND PENALTY OF PERJURY, THAT AT LEAST 75 PERCENT OF THE
GROSS RECEIPTS OF THE EVENT SHALL BE SPEND IN HOWARD COUNTY.
(II) WITHIN 30 DAYS AFTER A BONA FIDE
ORGANIZATION HAS HELD AN EVENT UNDER THIS SECTION, THE
ORGANIZATION SHALL SUBMIT TO THE HOWARDS COUNTY DEPARTMENT OF
PERMITS AND LICENSES AN ACCOUNTING OF ALL FUNDS RECEIVED OR
PLEDGED AS A RESULT OF THE EVENT, INCLUDING BUT NOT LIMITED TO
GROSS RECEIPTS, EXPENSES PAID OR INCURRED, AND THE NET AMOUNT
RECEIVED BY THE ORGANIZATION.
(6)(I) ANY ORGANIZATION THAT HOLDS AN EVENT
PERMITTED UNDER THIS SECTION SHALL FIRST OBTAIN A PERMIT FROM THE
DEPARTMENT OF PERMITS AND LICENSES:
(II) THE PERMIT APPLICATION SHALL BE MADE ON
FORMS PROVIDED BY THE DEPARTMENT OF PERMITS AND LICENSES AND
SHALL CONTAIN AN AFFIDAVIT THAT NO MEMBER OF THE ORGANIZATION
WILL RECEIVE ANY FEE OR COMPENSATION FOR MANAGING, SUPERVISING,
OR OPERATING AN EVENT PERMITTED UNDER THIS SECTION.
