AN ACT concerning

    Child or Spousal Support - Earnings Withholding

FOR the purpose of authorizing a court to issue an earnings
withholding order in a contempt or other proceeding under
certain circumstances; requiring a hearing under certain
circumstances; providing that an earnings withholding order
shall be of a certain amount; and generally relating to
child and spousal support and withholding of earnings.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:.

10-135.

(A) NOTWITHSTANDING ANY OTHER PROVISION OF THIS PART III, A
COURT MAY AT ANY TIME ISSUE AN EARNINGS WITHHOLDING ORDER, IN A
CONTEMPT OR OTHER PROCEEDING, IF:

           (1) THE RECIPIENT OR THE SUPPORT ENFORCEMENT AGENCY.
HAS FILED A PETITION THAT INCLUDES A REQUEST FOR AN EARNINGS
WITHHOLDING ORDER; AND                                                                     

(2) THE OBLIGOR IS IN ARREARS IN SUPPORT PAYMENTS OF
MORE THAN 30 DAYS.
