o'clock p.m., provided that an additional license fee of $500.00
shall first be paid for, such privilege granted by this section,
and provided further that the on-sale privilege herein granted
shall be limited to such on-sales by, a restaurant as defined in
[in] subsection (b) of this section.

(b)  For the purpose of subsection (a) of this section,
"restaurant" means a business establishment for the accommodation
of the public:

(1)  That is fully equipped with a proper and adequate
dining room and with sufficient facilities for preparing and
serving meals;

(2)  That has been approved by the board of license
commissioners of Cecil County; and

(3)   [Where in] WHEREIN the average annual receipts
from the sale of food comprise at least 51 percent of the average
receipts of the business.

DRAFTER'S NOTE: This deletes extraneous language and
corrects a misspelling in Article 2B, § 95B.

The extraneous language was added and the misspelling
occurred in Ch. 172 of the Acts of 1986.

The extraneous language was noted by the Michie
Company. The misspelling was noted by the Computer
Division of the Department of Legislative Reference.

(c)  In the sections of this article set forth below, the
hours for sale in Worcester County shall be:

(4) Section 11—Class D beer

(ii) 7 day license

(A) Countywide (exclusive of tenth
election [district] DISTRICT) as stated in § 11—(off-sale) 6:00
a.m. to 2:00 a.m. the following morning and on Sundays
(off-sale) 6:00 a.m. to 2:00 a.m. Monday; (on-sale) 9:00 a.m.
to 2:00 a.m. the following morning and on Sundays 12:30 p.m. to
2:00 a.m. Monday.

DRAFTER'S NOTE: This adds a closed parenthesis omitted from
Article 2B, § 106(c)(4)(ii)(A).

The omission of the parenthesis was a publishing error
which occurred in the printing of the 1974 Supplement
