(2) In Baltimore, Carroll, Cecil, Harford, [and]
Montgomery, AND PRINCE GEORGE'S counties, a person may not use,
sell, possess, set, place, or maintain a snare trap.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

CHAPTER 118

(House Bill 1221)

AN ACT concerning

Somerset County - Shellfish - Rights of Riparian
or Wharf Owners

FOR the purpose of applying to Somerset County certain provisions
of law concerning the exclusive right of certain riparian or
wharf owners to cultivate shellfish; and providing for the
effective date of this Act.

BY repealing and reenacting, with amendments,

Section 4-1119(a)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws' of Maryland read as follows:

Article - Natural Resources

4-1119.

(a) An owner or other lawful occupant shall have exclusive
right to use any creek, cove, or inlet for preserving or
depositing oysters or other shellfish if the water surface at the
mouth of the creek, cove, or inlet is 300 feet or less in width
at mean low water. However, this cove, creek or inlet may not be
included in the lines of any patent and all rights of the
riparian proprietor shall extend only to the middle of the creek,
cove, or inlet. [This subsection is not applicable within the
limits of Somerset County.] In the waters of St. Mary's County,
the riparian grounds of any creek, cove, or inlet meeting the
qualifications enumerated above shall be considered and treated
