WILLIAM DONALD SCHAEFER, Governor Ch. 61

(i) A Class "D" license shall be issued to
entities incorporated in [or] AND maintaining fixed storage tanks
in this State for motor vehicle fuel and who are not producers or
refiners and whose gasoline sales within this State equal or
exceed 50 percent of the total gallons of motor vehicle fuel
acquired, and who meet all of the following criteria:

1.   [Have] MAINTAIN AN INVENTORY OF MOTOR
VEHICLE FUEL AND HAVE a minimum storage capacity within this
State for motor vehicle fuel (excluding retail service stations)
of not less than 200,000 gallons;

2.  Have minimum annual sales of gasoline
within this State (excluding sales to other licensed dealers) of
1,000,000 gallons; and

3.  Post a surety bond in an amount set by
the Comptroller provided that in no case shall bond be less than
$200,000.

(ii) A Class "D" licensee may acquire tax
exempt motor vehicle fuel from any Class "A" or Class "D"
licensee.

(iii) A Class "D" licensee may not import motor
vehicle fuel into Maryland unless authorized to do so by the
Comptroller.

(g) (2) An exemption certificate authorizes the holder
thereof to purchase or otherwise acquire IN BULK special fuel or
turbine fuel, dependent upon class of license, tax exempt, from
[either a licensed dealer or] a special fuel seller.

148.

[(f) Except for petroleum transporters operating under
authority of the Interstate Commerce Commission or the Maryland
Public Service Commission, every vehicle used in transporting
petroleum products shall be identified on its tank portion with
the name or trademark of the owner as registered with the
Comptroller pursuant to subsection (b). Such identification
shall be readily discernible at a distance of 50 feet when the
vehicle is not in motion.]

(F) EVERY VEHICLE USED IN TRANSPORTING PETROLEUM PRODUCTS
SHALL BE IDENTIFIED ON ITS TANK PORTION, OR OTHER LOCATION
ACCEPTABLE TO THE COMPTROLLER, WITH THE NAME OF THE OWNER AS
REGISTERED WITH THE COMPTROLLER UNDER SUBSECTION (B) OF THIS
SECTION. EACH IDENTIFICATION SHALL BE DISCERNIBLE AT A DISTANCE
OF 50 FEET FROM THE SIDES OR REAR OF THE VEHICLE WHEN IT IS NOT
IN MOTION.
