AN ACT: (1) to establish development impact fees to build
highways in Germantown AND Eastern Montgomery County

(2)  to establish the applicability of development impact
fees, their geographic scope of coverage and the
procedure and criteria for the addition of impact fee
areas;

(3)  to impose a development impact fee at the time of
issuance of a building permit;

(4)  to set forth the procedure by which the development
impact fees shall be calculated;

(5)  to establish the procedure for biennial review and
recalculation of the development impact fee;

(6)  TO PROVIDE EXCEPTIONS;

(7)  to specify the circumstances under which a credit may
be granted as against the otherwise applicable
development impact fee;

(8)  to provide for an appeal from the imposition of the
development impact fee; AND

(9)  TO GENERALLY PROVIDE FOR THE IMPOSITION OF IMPACT FEES
TO BUILD HIGHWAYS.

By adding:

Chapter 49A, Sections 49A-1 through 49A-14 to the Montgomery
County Code.
