AN EMERGENCY ACT to clarify and strengthen the requirements
for right of entry on private property by the Animal Control
Officer.

By amending

Chapter 5, Animal Control

Section 5-18 of the Montgomery County Code

AN EMERGENCY ACT to:

(1)  provide that cruelty to animals is punishable as a
Class A violation;

(2)  expand the definition of cruelty to animals and make it
more specific;

(3)  provide for legislative intent;

(4)  make technical and stylistic changes;

(5)  remove a limitation on the authority of the Director of
the Department of Animal Control and Humane Treatment
that prevents protective removal of an animal from the
interior of a dwelling place;

(6)  delete the requirement that the Director designate
cruelty inspectors; AND

(7)  RAISE THE PENALTY FOR ABANDONING AN ANIMAL TO CLASS A.
