WILLIAM DONALD SCHAEFER, Governor

requires that each State receiving financial assistance
under the act must establish a State Planning council which
will serve as an advocate for persons with developmental
disabilities; and

WHEREAS, Maryland has had a State Planning council within State
government since 1971 and was re-constituted in Executive
Order 01.01.1973.08; and

WHEREAS, The Maryland State Planning council on developmental
Disabilities serves within the Department of Health and
Mental Hygiene; and

WHEREAS, Federal regulations require that State Planning Councils
must plan, monitor, and evaluate services for
developmentally disabled persons; and

WHEREAS, The State of Maryland wishes to enhance services and
policies affecting disabled citizens; and

WHEREAS, The Office for Handicapped Individuals is also charged
with monitoring and encouraging State government compliance
with laws and policies affecting handicapped individuals and
recommending changes on behalf of handicapped individuals
pursuant to Section 9-1105 of the State Government Article;
and

WHEREAS, The Governor has the power under Article II, Section 24
of the Maryland Constitution and Section 8-301 of the State
Government Article to order, not inconsistent with law, such
reorganizations as he may deem necessary and desirable.

NOW, THEREFORE, I, WILLIAM DONALD SCHAEFER, GOVERNOR OF THE STATE
OF MARYLAND, PURSUANT TO THE AUTHORITY VESTED IN ME BY THE
CONSTITUTION AND LAWS OF MARYLAND, HEREBY PROMULGATE THE
FOLLOWING ORDER AMENDING EXECUTIVE ORDER 01.01.1973.08:

[1. The appointments previously made by me to the State
Planning and Advisory Council pursuant to the aforesaid
Federal Act; and Regulations are hereby revoked.]

[2. The persons on the attached list are hereby appointed
as members of the said State Planning and Advisory Council
each to serve at my pleasure.]

A.  THERE IS A MARYLAND STATE PLANNING COUNCIL ON
DEVELOPMENTAL DISABILITIES WITHIN THE OFFICE FOR HANDICAPPED
INDIVIDUALS IN THE EXECUTIVE BRANCH OF GOVERNMENT.

B.  STAFF SUPPORT FOR THE MARYLAND STATE PLANNING COUNCIL ON
DEVELOPMENTAL DISABILITIES SHALL BE PROVIDED BY THE OFFICE
FOR HANDICAPPED INDIVIDUALS. SUPERVISION OF STAFF WILL BE
PROVIDED BY THE COUNCIL.
