VETOES

for grants which may be awarded to the Administration under
federal law, including without limitation Title V of the Energy
Security Act, P.L. 96-294, grants of land or money shall be
limited to local governments or to organizations which are
defined under § ll-303(c-l), (h), (i), (j), and (1) of this
subtitle.

11-303.

(c-1) "COMMUNITY OR NEIGHBORHOOD ORGANIZATION" MEANS A
COMMUNITY OR NEIGHBORHOOD ORGANIZATION; NO PART OF THE NET

EARNINGS OF WHICH INURES TO THE BENEFIT OF ANY PRIVATE

INDIVIDUAL, ORGANIZED AND OPERATED FOR THE PURPOSES OF FOSTERING,
ENCOURAGING, AND ASSISTING WITH THE PROMOTION OF COMMUNITY OR
NEIGHBORHOOD NEEDS AND CONCERNS.

     (C-l) "NONPROFIT ORGANIZATION" MEANS A CORPORATION,

FOUNDATION, OR OTHER LEGAL ENTITY, NOT ORGANIZED FOR PROFIT, NO
PART OF THE NET EARNINGS OF WHICH INURES TO THE BENEFIT OF ANY
PRIVATE SHAREHOLDERS OR INDIVIDUAL HOLDING AN INTEREST IN SUCH
ENTITY, AND THAT;

(I) IS ORGANIZED AND OPERATED FOR THE PURPOSES OF
FURNISHING USEFUL AND NECESSARY SERVICES TO NEIGHBORHOODS OR
COMMUNITIES; AND

(II) HAS BEEN DETERMINED TO BE EXEMPT FROM INCOME
TAXATION UNDER § 501 OF THE INTERNAL REVENUE CODE.

11-304.

The Administration shall have the following functions and
responsibilities:

(8) Provide advisory, consultative, training and
educational services, technical assistance, and grant and loan
funds therefor and for any development cost to any municipality,
county, local public agency, [or] local development corporation,
OR NONPROFIT ORGANIZATION in order to carry out the community
development purposes of this subheading.

11-305.

(e) In effectuating the purposes of this subheading, the
Administration shall work closely, consult and cooperate with
local elected officials. The Administration shall give primary
consideration to local needs and desires and shall foster local
initiative and participation in connection with the planning and
development of community developments. Wherever possible, the
Administration shall carry out community development projects in
conjunction with and through the use of private enterprise,
limited dividend corporations, local development agencies, [and]
local development corporations, AND COMMUNITY AND NEIGHBORHOOD
