(II) REQUIRE A PROSPECTIVE FULL-TIME EMPLOYEE
WHO IS SEEKING A WORKWEEK CONSISTING OF 25 HOURS OR MORE TO
ANSWER ANY QUESTIONS IDENTIFYING THE DAY OF THE WEEK THAT
EMPLOYEE CHOOSES AS A DAY OF REST OR SABBATH.

(4) NOTWITHSTANDING ANY AGREEMENT TO THE CONTRARY
BETWEEN A MERCHANT AND HIS LANDLORD, A MERCHANT MAY NOT BE
REQUIRED DIRECTLY OR IND1RECTLY TO OPEN THE MERCHANT'S PLACE OF
BUSINESS ON SUNDAY.

(5) NOTWITHSTANDING ANY AGREEMENT TO THE CONTRARY
BETWEEN A MERCHANT AND THE LANDLORD OF THE MERCHANT, A LANDLORD
MAY NOT CANCEL OR REFUSE TO RENEW, DIRECTLY OR INDIRECTLY, THE
LEASE OF A MERCHANT BECAUSE OF THE MERCHANT'S REFUSAL TO OPEN THE
MERCHANT'S PLACE OF BUSINESS ON SUNDAY.

(C) (1) (I) ANY EMPLOYER, WHO VIOLATES THE PROVISIONS OF
THIS SECTION, IS GUILTY OF A MISDEMEANOR AND, UPON CONVICTION:,
SHALL BE FINED NOT LESS THAN $250 NOR MORE THAN $500 FOR EACH
OFFENSE

1. FOR THE FIRST CONVICTION, IS SUBJECT
TO A FINE NOT EXCEEDING $500 FOR EACH OFFENSE;

2. FOR THE SECOND CONVICTION, IS SUBJECT
TO A FINE NOT EXCEEDING $1,000 FOR EACH OFFENSE; AND

3. FOR SUBSEQUENT CONVICTIONS, IS SUBJECT
TO A FINE NOT EXCEEDING $5,000 FOR THE OFFENSE.

(II) IF AN EMPLOYER COMPELS A NONMANAGERIAL OR
NONPROFESSIONAL EMPLOYEE TO WORK ON HIS CHOSEN DAY OF REST IN
VIOLATION OF THE PROVISIONS OF THIS SECTION, THAT EMPLOYER SHALL
BE LIABLE TO THE AGGRIEVED EMPLOYEE FOR WAGES AT THE RATE OF 3
TIMES THE EMPLOYEE'S REGULAR RATE OF PAY FOR ALL HOURS WORKED BY
THAT EMPLOYEE ON HIS CHOSEN DAY OF REST.

(2) THIS SECTION MAY NOT BE CONSTRUED TO PERMIT ANY
FINE OR PENALTY AGAINST ANY SUPERVISORY EMPLOYEE OR AGENT WHO HAS
BEEN CAUSED, DIRECTED, OR AUTHORIZED BY HIS EMPLOYER TO VIOLATE
ANY PROVISION OF THIS SECTION, IN WHICH CASE THE EMPLOYER SHALL
BE SUBJECT TO THE SANCTIONS PRESCRIBED BY THIS SECTION.

(D) THE PROVISIONS OF THIS SECTION DO NOT APPLY TO THE LAWS
PERTAINING TO ALCOHOLIC BEVERAGES SALES ON SUNDAY OR TO THE
SERVICE OF PROCESS ON SUNDAY.------------------------------------------

(a) The provisions of this section apply to any retail
establishment or wholesale establishment that operates in
Baltimore County and Baltimore City on any Sunday.
