WILLIAM DONALD SCHAEFER, Governor Ch. 685

(1)  ANY REFERENDUM REQUIREMENTS OF THE CHARTER OR
OTHER LOCAL LAW OF THE COUNTY ISSUING THE BONDS OR IN WHICH THE
PROGRAMS OR PROJECTS ARE LOCATED; OR

(2)  ANY LIMITATION OF THE CHARTER OR LOCAL LAW ON THE
RATE OF TAXATION OR THE AGGREGATE AMOUNT OF TAXES THAT MAY BE
LEVIED WITHIN THE ISSUING COUNTY.; OR

(3)  ANY REQUIREMENT OF CHARTER OR LOCAL LAW AS TO THE
FORM OR PUBLIC SALE OF THE BONDS.

(F) THIS SECTION SHALL CONSTITUTE AND SHALL BE CONSTRUED AS
INDEPENDENT, ADDITIONAL, AND SUPPLEMENTAL AUTHORITY FOR
MONTGOMERY COUNTY AND PRINCE GEORGE'S COUNTY TO ISSUE BONDS FOR
THE PURPOSES PROVIDED ON ENACTMENT OF AN ORDINANCE OR OTHER
LEGISLATIVE ACT BY THE ISSUING COUNTY.

3-204.

(a) (1) [The WSSC] IN THE STORMWATER MANAGEMENT DISTRICT,
PRINCE GEORGE'S COUNTY may require any owner or developer of a
subdivision or tract of land on which dwellings, apartments,
stores, or other buildings are to be erected to contribute what
the [WSSC] COUNTY determines to be a fair share of the cost of a
[drainage] STORMWATER MANAGEMENT project [in the WSSC's
jurisdiction] before the [WSSC] COUNTY approves or constructs the
project.

(2) The City of Bowie has the authority provided in
paragraph (1) of this subsection with respect to those portions
of the City of Bowie that had been under the jurisdiction of the
WSSC before July 1, 1978 for purposes of [storm and surface water
drainage control] STORMWATER MANAGEMENT.

(2) IN THE CITY OF BOWIE, THE CITY MAY REQUIRE ANY
OWNER OR DEVELOPER OF A SUBDIVISION OR TRACT OF LAND ON WHICH
DWELLINGS, APARTMENTS, STORES, OR OTHER BUILDINGS ARE TO BE
ERECTED TO CONTRIBUTE WHAT THE CITY DETERMINES TO BE A FAIR SHARE
OF THE COST OF A STORMWATER MANAGEMENT PROJECT BEFORE THE CITY
APPROVES OR CONSTRUCTS THE PROJECT.

(3)  In Montgomery County, [except for property in
that portion of the City of Takoma Park in Montgomery County,]
the Montgomery County Council may require any owner or developer
of a subdivision or tract of land on which dwellings, apartments,
stores, or other buildings are to be erected to contribute what
the County Council determines to be a fair share of the cost of a
drainage project in the county's jurisdiction before the County
Council approves the project for construction.

(4)  Before construction begins the contribution shall
be paid in cash or secured to the satisfaction of the approving
authority.
