WILLIAM DONALD SCHAEFER, Governor                   Ch. 679

(8) Land. To acquire by gift, purchase, or by the
exercise of the right of eminent domain, in the manner prescribed
by Article 33A of the Annotated Code of Maryland, lands, rights
in land, or water rights in connection with land. Property or
any interest or estate in property owned by any county, municipal
corporation, or other political subdivision of the State may not
be acquired by the exercise of the power of eminent domain
without the consent of the governing body of the county,
municipal corporation, or political subdivision. Ten days after
the return and recordation of the verdict or award in any
condemnation proceedings, the Commission may enter and take
possession of the condemned property, after first paying to the
Clerk of the Court the amount of the award and all costs taxed to
that date, notwithstanding any appeal or further proceedings upon
the part of the defendant. At the time of the payment, however,
the District shall give its corporate undertaking to abide by and
fulfill any judgment in the appeal or further proceedings. IN
ANY ACQUISITION OF LAND BY GIFT, PURCHASE, OR EMINENT DOMAIN THE
DISTRICT SHALL MAY ACQUIRE LAND OUTSIDE OF A SUBDISTRICT BY GIFT
OR PURCHASE PROVIDED THAT THE LAND IS NOT LOCATED OUTSIDE OF
WASHINGTON COUNTY AND IS REASONABLY NECESSARY FOR INSTALLATION
OF:

(I)  SEWERS;

(II)  PORTABLE WATER MAINS;

(III)  SURFACE WATER DRAINAGE LINES;

(IV)  SWALES;

(V)  PUMPING STATION TREATMENT PLANTS; OR

(VI)  FACILITIES INTENDED TO SERVE A SEWER,
WATER, OR SURFACE WATER DRAINAGE SYSTEM LOCATED ENTIRELY OR
PARTLY WITHIN ANOTHER SUBDISTRICT.

(c) If, within 10 days after the date of the hearing, not
less than 25 persons owning property which will be subject to
tax, assessment, or charge to pay the cost of any project
considered at the hearing, file with the Commission a written
petition protesting any project and setting forth reasons for the
protest, the Commission shall decide upon the reasonableness of
the objections stated in the petition. THE PETITION SHALL
CONTAIN, LEGIBLY PRINTED OR TYPEWRITTEN, THE NAME AND ADDRESS OF
EACH PETITIONER, AS WELL AS THE WRITTEN SIGNATURE OF EACH
PETITIONER. EACH PETITIONER SHALL INCLUDE ON THE PETITION AN
INDICATION OF WHETHER THE PETITIONER OWNS PROPERTY WITHIN THE
SANITARY SUBDISTRICT WHICH IS THE SUBJECT OF THE PROTEST. ANY
PETITION THAT DOES NOT CONTAIN THE INFORMATION REQUIRED BY THIS
SUBSECTION IS INVALID. ONLY THE SIGNATURES OF PERSONS OWNING
