2-303.1.

The Department may not adopt regulations to implement Stage
II of the [Vapor Recovery Control System for fuel pumps] PROGRAM
FOR VOLATILE ORGANIC EMISSIONS CONTROL FROM GASOLINE RETAILING
OPERATIONS unless:

(1)  The Department is mandated by the United States
Environmental Protection Agency;

(2)  The Department is unable to find other control
strategies; and

(3)  The Environmental Protection Agency publishes
notice in the Federal Register that the State of Maryland is not
in compliance with the provisions of the Clean Air Act {[42
U.S.C. § 7401 through 7602] 42 U.S.C. §§ 7401 THROUGH 7602).

DRAFTER'S NOTE: This corrects a misnomer of a program and
corrects a stylistic error in a cross-reference in §
2-303.1 of the Health - Environmental Article.

The misnomer was contained in, and the stylistic error
occurred in, Ch. 727 of the Acts of 1986.

The misnomer was noted by the State Attorney General
in his bill review letter of May 14, 1986. The
stylistic error was noted by the Computer Division of
the Department of Legislative Reference.

(a) Any drug that is designated as a "controlled dangerous
substance" under the provisions of Article 27, § 276 et seq.
(subheading "Health—Controlled Dangerous Substances") of the
Code [are] IS governed by that subheading as well as by this
subtitle.

DRAFTER'S NOTE: This corrects a grammatical error in §
4-202(a) of the Health - Environmental Article.

The grammatical error occurred in Ch. 240 of the Acts
of 1982.

The grammatical error was noted by the Computer
Division of the Department of Legislative Reference.
