AN ACT concerning

Major Medical Equipment - Licensure

FOR the purpose of removing a certain licensing exemption for
health maintenance organizations; and extending the
termination date for the laws relating to licensing
requirements for certain major medical equipment.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

19-1001.                                                                                                   

(a)  In this subtitle the following words have the meanings
indicated.

(b)   "License" means a license issued by the Secretary to
operate major medical equipment.

(c)   "Major medical equipment" means medical equipment that
is used to provide health care services and for which the total
cost of the equipment exceeds $600,000 after adjustment for
inflation as provided in regulations adopted by the Secretary.

(d)  (1) "Provisional license" means a license issued by the
Secretary to operate major medical equipment for which licensing
standards have not yet been adopted.

(2) A provisional license shall only be valid until
regulations establishing licensing standards are in effect.
