AN ACT concerning
Environmental Health - Regulation by State - Water,
Ice, and Sanitary Facilities
FOR the purpose of revising, restating, clarifying, and
recodifying a subtitle of the Health - Environmental
Article, to be designated and known as "Title 9, Subtitle 2.
Regulation by State", relating and pertaining to the way in
which this State regulates water, ice, and sanitary
facilities, including the power and duty of this State to
regulate refuse disposal systems, incinerators, transfer
stations, landfill systems, landfills, sewage, sewage
sludge, sewerage systems, and water supply systems; revising
the laws relating to water supply systems, sewerage systems,
refuse disposal systems, and sewage sludge, including
permits to operate landfills and landfill systems and
permits to utilize or apply sewage sludge to land in this
State; revising the laws relating to applications for
various permits, notices, hearings, and scope, term,
removal, suspension, revocation, and modification of various
permits; revising the laws relating to the powers and duties
of the State Department of Health and Mental Hygiene, the
State Department of Agriculture, the State Department of
Natural Resources, and the Secretary of Health and Mental
Hygiene concerning water supply systems, sewerage systems,
refuse disposal systems, and sewage sludge; providing that
the Secretary of Health and Mental Hygiene may not prohibit
certain persons in St. Mary's County from constructing
certain wells and privies so long as certain conditions are
fulfilled; revising the laws relating to the powers and
duties of local health officials, sanitary district
districts, sanitary districts district authorities, sewerage
authorities, water authorities, the federal government, a
state, county, or municipal corporation, political
subdivisions, and any of their units concerning water supply
systems, sewerage systems, refuse disposal systems, and
sewage sludge; revising the laws relating to injunctions,
standing to sue or intervene in actions, judicial review,
and appeals of certain actions concerning water supply
systems, sewerage systems, refuse disposal systems, and
sewage sludge; defining certain terms; providing for the
scope of this Act; providing for the effect, construction,
and effective date of the provisions of this Act; providing
for the codification of this Act; and generally relating to
matters concerning regulation by the State of water, ice,
and sanitary facilities in Title 9, Subtitle 2 of the Health
- Environmental Article.
