(A)(1) ON OR BEFORE JULY 1, 1988, THE COMMISSION SHALL
ADOPT REGULATIONS WHICH PHYSICIANS SHALL USE TO MEASURE PERMANENT
IMPAIRMENT WHEN PREPARING MEDICAL EVALUATIONS FOR REPORTS TO THE
COMMISSION ON THE MEDICAL CONDITION OF CLAIMANTS.
(2) THE REGULATIONS SHALL INCLUDE ALL MEDICALLY
RECOGNIZED CRITERIA OF PHYSICAL IMPAIRMENT, INCLUDING, BUT NOT
LIMITED TO, LOSS OF FUNCTION, RANGE OF MOTION, PAIN, WEAKNESS,
ATROPHY, AND ENDURANCE.
(B) THE REGULATIONS TO BE ADOPTED BY THE COMMISSION UNDER
SUBSECTION (A) ARE REGULATIONS UNDER SUBTITLE 1, TITLE 10 OF THE
STATE GOVERNMENT ARTICLE.
(C) UNTIL THE COMMISSION ADOPTS REGULATIONS IN ACCORDANCE
WITH SUBSECTION (A) OF THIS SECTION, PHYSICIANS, WHEN MEASURING
PERMANENT IMPAIRMENT IN PREPARING MEDICAL EVALUATIONS FOR REPORTS
TO THE COMMISSION ON THE MEDICAL CONDITION OF CLAIMANTS, SHALL
USE THE MOST RECENT EDITION OF THE AMERICAN MEDICAL ASSOCIATION'S
GUIDES TO THE EVALUATION OF PERMANENT IMPAIRMENT" AND THE
CRITERIA REFERRED TO IN SUBSECTION (A)(2) OF THIS SECTION.
(A) ON OR BEFORE JULY 1, 1988, THE COMMISSION SHALL ADOPT
GUIDES TO BE USED BY PHYSICIANS TO MEASURE AND REPORT TO THE
COMMISSION ALL MEDICAL EVALUATIONS OF PERMANENT IMPAIRMENTS,
INCLUDING LOSS OF FUNCTION, ENDURANCE, AND RANGE OF MOTION, AND
PAIN, WEAKNESS, AND ATROPHY.
(B) THE GUIDES TO BE ADOPTED BY THE COMMISSION UNDER
SUBSECTION (A) OF THIS SECTION ARE REGULATIONS UNDER SUBTITLE 1,
TITLE 10 OF THE STATE GOVERNMENT ARTICLE.
(C) ON OR AFTER JULY 1, 1987, AND UNTIL THE COMMISSION
ADOPTS GUIDES UNDER SUBSECTION (A) OF THIS SECTION, PHYSICIANS
SHALL USE THE MOST RECENT EDITION OF THE AMERICAN MEDICAL
ASSOCIATION'S "GUIDES TO THE EVALUATION OF PERMANENT IMPAIRMENT",
AS AMENDED, TO MEASURE ALL MEDICAL EVALUATIONS OF PERMANENT
IMPAIRMENTS. PHYSICIANS SHALL REPORT THE1R FINDINGS IN
ACCORDANCE WITH THOSE GUIDES.------------------------------------------
(D) UNTIL THE COMMISSION ADOPTS GUIDES UNDER SUBSECTION (A)
OF THIS SECTION, A PHYSICIAN, IN EVALUATING A PERMANENT
