not be required to open the merchant's place of business on
Sunday under certain circumstances; providing that a
landlord may not cancel or refuse to renew the lease of a
merchant because the merchant refuses to open the merchant's
place of business on Sunday; providing certain penalties and
an injunctive relief procedure; generally referring to
Wicomico County and Sunday business prohibition; and
submitting this Act to a referendum of the legally qualified
voters of Wicomico County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 534M of Article 27 - Crimes and
Punishments of the Annotated Code of Maryland be repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

Article 27 - Crimes and Punishments

534M.

(A) (1) IN THIS SECTION, THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED.

(2) "MANAGERIAL EMPLOYEE" MEANS ANY EMPLOYEE WHO IS
NOT COVERED BY A COLLECTIVE BARGAINING AGREEMENT AND

(I)  WHOSE PRIMARY DUTIES CONSIST OF THE
MANAGEMENT OF THE ENTERPRISE IN WHICH THAT PERSON IS EMPLOYED OR
OF A CUSTOMARILY RECOGNIZED DEPARTMENT OR SUBDIVISION OF THAT
ENTERPRISE;

(II)  WHO CUSTOMARILY AND REGULARLY DIRECTS THE
WORK OF 2 OR MORE OTHER EMPLOYEES IN THE ENTERPRISE, DEPARTMENT,
OR SUBDIVISION OF THAT ENTERPRISE;
