AN ACT concerning
Airport Noise Zone Acquisition Fund
Assistance Programs - BWI Airport Noise Zone -
Residential Areas
FOR the purpose of guaranteeing against loss of property value by
establishing and providing for the funding of an Airport
Noise Zone Acquisition Fund; requiring the Secretary of
Transportation or the Secretary's designee to administer and
control the Fund; requiring the Fund to be used for the
purchase and resale of certain properties, or to compensate
for loss of property value located in the airport noise
zone; requiring the Fund to be a revolving fund; requiring
that the contract of sale contain certain notice
requirements and that such notice requirement constitutes an
easement; establishing the Board of Airport Zoning Appeals
as the panel to review certain appeals; defining certain
terms; and generally relating to the establishment and
funding of the Airport Noise Zone Acquisition Fund
establishing a program for the voluntary acquisition of
residentially used real property and to assure the resale of
such real property within a certain area of the
Baltimore-Washington International Airport Noise Zone;
establishing a Homeowners Assistance Pilot Program;
requiring a report by the State Aviation Administration to
the General Assembly; requiring certain property owners to
grant an avigation easement to the Administration under
certain circumstances; restricting the variance granting
power of the Board of Airport Zoning Appeals under certain
circumstances; defining certain terms; and generally
relating to the establishment of noise assistance programs
addressing residential areas within the Baltimore-Washington
International Airport Noise Zone.
BY repealing and reenacting, with amendments, adding
Article - Transportation
Section 5-824, 5-825, and 5-826 5-1201 through 5-1204,
inclusive, to be under the new subtitle "Subtitle
12. Airport Noise Assistance Programs"
