Ch. 531                                    LAWS OF MARYLAND

deputy sheriff to county service shall be determined by the
county.

SECTION 2. AND BE IT FURTHER ENACTED, That notwithstanding
any provision of the county's charter or local law to the
contrary, deputy sheriffs in Anne Arundel County on June 30,
1987, may be placed in county merit positions without being
required to submit to a competitive hiring process. Any transfer
of benefits from service as a deputy sheriff to County service
shall be determined by the County.

SECTION 3. AND BE IT FURTHER ENACTED, That, pursuant to
Article III, Section 35, of the Constitution of Maryland, this
Act may not be construed to extend or apply to the salary or
compensation of the Anne Arundel County Sheriff in office on the
effective date of this Act, but the provisions of this Act
concerning the salary or compensation of the Anne Arundel County
Sheriff shall take effect at the beginning of the next following
term of office.

SECTION 3. AND BE IT FURTHER ENACTED, That:

(1) On and after July 1, 1987, the salary of a deputy
sheriff in Anne Arundel County who was appointed before July 1,
1987, shall equal or exceed that deputy's salary on June 30,
1987.

(2) On and after July 1, 1987, the number of deputies
employed by the Sheriff of Anne Arundel County shall equal or
exceed:

(i) the number of deputies employed on June 30,
1987; less

(ii) the number of deputies who were employed
as deputies in the Sheriff's office on June 30, 1987, and who
have since retired or otherwise voluntarily left the employment
of the Sheriff's office.

SECTION 4. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason in a court of
competent jurisdiction, the invalidity does not affect other
provisions or any other application of this Act which can be
given effect without the invalid provision or application, and
for this purpose the provisions of this Act are declared
severable.
