AN ACT concerning

State Board of Examiners of Nurses - Nursing Education Programs

FOR the purpose of altering the circumstances under which the
State Board of Examiners of Nurses may remove an institution
from its list of institutions that offer approved nursing
education programs in the State; and generally relating to
removal of institutions from the State Board of Examiners of
Trustees Nurses list.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations

7-404.

(a) The EXCEPT AS PROVIDED IN SUBSECTION (B) OF THIS
SECTION, THE Board may remove an institution from its list of
institutions that offer approved nursing education programs in
this State if the institution[:

(1)] Violates the standards set under this title or
by the Board[; and

(2) Does not correct the violation in a reasonable
time after notice is given].

(B) (I) (1) AT LEAST 30 30 DAYS BEFORE THE BOARD MAY
ISSUE A FORMAL NOTICE OF VIOLATION TO AN INSTITUTION, THE BOARD
SHALL NOTIFY THE CHIEF ADMINISTRATOR OF THE INSTITUTION AND THE
CHIEF ADMINISTRATOR OF THE NURSING EDUCATION PROGRAM OF THE
INSTITUTION THAT THE BOARD IS CONSIDERING ISSUING A FORMAL NOTICE
OF VIOLATION.                   

(II) (2) DURING THE 30-DAY PERIOD PROVIDED IN

PARAGRAPH (I) (1) OF THIS SUBSECTION, THE BOARD SHALL PROVIDE THE

CHIEF ADMINISTRATOR OF THE INSTITUTION AND THE CHIEF

ADMINISTRATOR OF THE NURSING EDUCATION PROGRAM AN OPPORTUNITY TO

MEET WITH REPRESENTATIVES OF THE BOARD.
