AN ACT concerning

Planning Commissions -
Commercial Fishing Activities - Counties on Tidal Waters

FOR the purpose of requiring the planning commissions of certain
counties located on tidal waters to designate amend or
included in certain plans by a certain date the designation
of areas In the counties for certain uses for commercial
fishing activities; requiring the designated areas of the
counties to be located in certain areas for certain
purposes; and generally relating to the location of
activities related to commercial fishing in certain areas of
certain counties of the State.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 66B - Zoning and Planning

3.05.

(a) (4) (I) AS A COMPONENT OF ITS COMPREHENSIVE PLAN, EACH
PLANNING COMMISSION OF A COUNTY THAT IS LOCATED ON THE TIDAL
WATERS OF THE STATE AND THAT EXERCISES AUTHORITY UNDER THIS
ARTICLE SHALL DESIGNATE AMEND OR INCLUDE IN ITS PLAN BY JANUARY
1, 1988 THE DESIGNATION OF AREAS ON THE TIDAL WATER OR IN CLOSE
PROXIMITY TO THE TIDAL WATER FOR THE FOLLOWING PURPOSES:

1.  LOADING AND UNLOADING FINFISH AND
SHELLFISH;

2.  PROCESSING FINFISH AND SHELLFISH; AND

3.  DOCKING AND MOORING COMMERCIAL FISHING
BOATS AND VESSELS.

(II) THE DESIGNATED AREAS UNDER PARAGRAPH
(4)(I) OF THIS SUBSECTION SHALL BE GEOGRAPHICALLY LOCATED IN
ORDER:
