LAWS OF MARYLAND
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - Natural Resources
3-1.03.
(b) (1) There are four officers of the Service:, a
director, a deputy director, a secretary, and a treasurer. Each
officer shall be appointed by the Secretary of Natural Resources,
with the approval of the Governor, solely with regard to his
qualifications for the duties of his office. Each officer serves
at the pleasure of the Secretary of Natural Resources. The
director, deputy director, secretary, and treasurer shall receive
the compensation provided in the State budget. THE FOUR OFFICERS
OF THE SERVICE SHALL BE APPOINTEE AS FOLLOWS:
(I) THE DIRECTOR AND DEPUTY DIRECTOR SHALL BE
APPOINTED BY THE SECRETARY OF NATURAL RESOURCES, WITH THE
APPROVAL OF THE GOVERNOR. SOLELY WITH REGARD TO THE
QUALIFICATIONS FOR THE DUTIES OF THE OFFICE. THE DIRECTOR AND
DEPUTE DIRECTOR SERVE AT THE PLEASURE OF THE SECRETARY OF NATURAL
RESOURCES AND SHALL RECEIVE THE COMPENSATION PROVIDED IN THE
STATE BUDGET; AND
(II) THE SECRETARY AND TREASURER SHALL BE
APPOINTED BY THE SECRETARY OF NATURAL RESOURCES, WITH THE
APPROVAL OF THE GOVERNOR AND THE ADVICE AND CONSENT OF THE SENATE
SOLELY WITH REGARD TO THE QUALIFICATIONS FOR THE DUTIES OF THE
OFFICE. THE SECRETARY AND TREASURER SERVE AT THE PLEASURE OF THE
SECRETARY OF NATURAL RESOURCES AND SHALL RECEIVE THE COMPENSATION
PROVIDED IN THE STATE BUDGET.
(2) The board of directors of the Service shall
consist of 7 members as follows:
(i) The director, deputy director, secretary,
and treasurer of the Service;
(ii) 1 member from the public sector in the
State in a position responsible for water, wastewater, or solid
waste management; and
(iii) 2 members from the private sector in the
State with technical, financial, development, or legal experience
related to water, wastewater, or solid waste management.
(3) The EXCEPT FOR THE DIRECTOR AND DEPUTY DIRECTOR,
THE THE PUBLIC SECTOR AND PRIVATE SECTOR members of the board, AS
SET FORTH IN SUBPARAGRAPHS (II) AND (III) OF PARAGRAPH (2) OF
THIS SUBSECTION. WHO ARE NOT OFFICERS OF THE SERVICE shall be
appointed by the Secretary of Natural Resources, with the
