and (3) any substance or mixture of substances intended to be
used as a spray adjuvant such as a wetting agent or adhesive.

(k) "Pest control consultant" means any person who engages
in the business of offering or supplying technical advice or
supervision, inspecting for or identifying pests, or recommending
the use of specific pesticides for the purpose of controlling
pests in or on water, air, land, plants, structures, or animals.

(1) "Pest control applicator" means a person engaged in the.
business of structural pest control, commercial extermination,
fumigation, or providing any other service involving the use of
pesticides or devices for controlling, eradicating, mitigating,
or preventing pests in or around any house or building.

(m) "Private applicator" means a person who uses any
restricted use pesticide for the purpose of producing any
agricultural commodity on property owned or rented by him or his
employer or, if applied without compensation other than trading
of personal services between producers of agricultural
commodities, on the property of another person.

(n) "Public agency applicator" means any person employed by
any unit of federal, State, county or local government or any
training institution engaged in pest control, extermination or
fumigation, or involved in the use of pesticides or devices for
controlling, eradicating, mitigating, or preventing pests.

(o) "Restricted use pesticide" means a pesticide so
classified by the federal government or the Secretary of
Agriculture, State of Maryland.

(p) "Registered employee" means an employee of a firm
engaged in commercial pest control who applies pesticides or
sells pesticide application services and sales personnel who
recommend pesticide usage in contracting for the application.

(q) "Supervision" unless otherwise prescribed by federal or
State labeling means the act or process whereby the application
of a pesticide is made by a competent person acting under the
instructions and control of a certified applicator who is
responsible for the actions of that person and who is available
if and when needed even though such certified applicator may not
be physically present at the time and place the pesticide is
applied.]

(3) "APPLICATION" MEANS THE SPREADING OF PESTICIDES, BY
CONTRACT OR OTHERWISE, FOR ANY PERSON OWNING OR RENTING PROPERTY.

(C) "CERTIFIED APPLICATOR" MEANS A PERSON WHO IS CERTIFIED

BY THE SECRETARY UNDER THIS SUBTITLE.
