AN ACT concerning

Landfill System Permits

FOR the purpose of altering the period of expiration of a
landfill system permit; authorizing a permit holder to renew
a landfill system permit before it expires for a certain
term of years; and generally relating to landfill system
permits.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

9-213.

(a)  A permit for a landfill system expires on the [3rd] 5TH
anniversary of its effective date, unless the permit is renewed
for a [3-year] 5-YEAR term as provided in this section;

(b)  Before a permit for a landfill system expires, the
permit holder may renew it for an additional [3-year] 5-YEAR
term, if the permit holder:

(1) Submits to the Department a renewal application
on the form that the Department requires; and

(2) Obtains the written approval of the Department.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987, contingent on the taking effect of
Chapter of the Acts of 1987 (S.B. 323), and if Chapter does
not become effective, the publisher of the Annotated Code of
Maryland, the Michie Company, is directed to incorporate the
changes made by this Act into the appropriate places in the
Health - Environmental Article of the Annotated Code of Maryland
without the necessity of further action by the General Assembly.
