This subtitle does not apply to the manufacture of ice cream

(a)  The Secretary may adopt the rules and regulations
necessary to carry out the provisions of this subtitle.

(b)  The Secretary shall prepare abstracts of this subtitle
and provide them, on request, to any person.]

[Part II. Licensing]

[4-606.

(a)  Except as otherwise provided in this subtitle, a person
shall be licensed by the Secretary to operate a cannery before
the person may operate the cannery in this State.

(b)  Except as otherwise provided in this subtitle, a person
shall be licensed by the Secretary to operate a frozen food
processing plant before the person may operate, the frozen food
processing plant in this State.]

To qualify for a license, an applicant shall satisfy the
Secretary that the cannery or frozen food processing plant is:

(1)  In a sanitary condition;

(2)  Supplied with water that is not dangerously

polluted; and

(3)  Located or constructed so that the drainage,

inedible products, liquid, or waste:

(i) Readily can be removed, stored, or

destroyed; and

(ii) Will not be a nuisance or create an
unsanitary condition.]

An applicant for a license shall submit an application to
the Department on the form that the Secretary requires.]
